Most people who mod/glitch have big mouths so everything gets patched or you get banned because you tell everyone. Here is a good hint keep it to your self or just a few people. spread it in secret not to the public. Might help everyone.

i did this like once..will i get banned? i dont really care since xboxes are like 100 bucks..but if i have to download all of my content again from getting profile banned, that'd be bullcrap.

i guarantee you they downloaded from the history. They obviously say they didnt because they know they arent suppose too. Microsoft ARE banning people for this but only if you download from history. They are getting serious but theres no way they can tell if your account is playing it from another modded profile. As for people who do license transfers you are fine. That isnt illegal
