Yes they are are they are a MODIFIED console that is mainly used for hacks

So my guess under british law that they are

From what I understand, they're not illegal. However illegal activities can take place on them.
Such as downloading games for free and placing them on your HDD to play them.

They are NOT illegal. They can not be used to commit crimes "crimes like pirating games is illegal". If they could take/destroy XBL users account then yes maybe.

They are illegal to Microsoft though"if you use one online you will be console banned".

I think you pretty much summed it up, modified consoles are not illegal.

Is a lighter illegal? No, but can it do illegal stuff? Yes, same goes with jtags. They are not illegal, but pirating games is.

you could get games from gamefly copy them and send them
back and you can also download Games

As many before me have said JTAG's themselves are legal. Homebrew is what is illegal.
