Well you quite possibly could get banned, it all depends on whether people report you for the account name being offensive.

my friend had a gamertag that was "offensive." he did not get banned, microsoft chose told him that that username violates... and he needs to change it.

I have been banned until 12/31/9999 maybe bad luck, I think I deleted the email it was last year but I'll search I remember one of the reasons was because of my gamertag.

the 1st one may get you banned but i would not think the chance would be very high
