Yes there is a little little chance that you get profile banned.
The most chance is a cheaters pool, but im hosting 2 weaks, and im still not banned or
something like that.

There is also a DNS which get you out of the cheaters pool/ BadSport lobby.

So practically from I am hearing from most of the Powell is that I'm only in danger of cheater pool or bad sport lobby.

ypu cant get console banned becuase your console isnt modified but if you have a jtag rgh or what ever it will you will get banned from GTA servers or cheater pool if you get caught
