EFF stands behind Datel in Microsoft suit over third-party 360 memory cards

The suit, has Microsoft accusing Datel of selling cards which it claims causes Xbox users to violate the the Digital Millennium Copyright Act and US federal law should they use the third-party cards in their system.

However, the EFF said the DMCA was instilled to prevent access to copyrighted material by non-paying customers, not created to block “competitors or policing users’ behavior in regards to their own property.”

“Letting Xbox owners use a third-party memory card does not put Microsoft at risk of copyright infringement,” said EFF Intellectual Property Director Corynne McSherry. “Microsoft is misusing the law in order to sell more accessories and control customers’ use of the Xbox. The DMCA is supposed to be a shield against piracy, not a weapon to smash competition and consumer choice.

“If Microsoft were to prevail on this point, it could give the software giant the ability to use the DMCA to prevent competitors from selling Xbox-compatible accessories, like memory cards, controllers, and headsets. Such a ruling would have wide-ranging ramifications for hundreds of other consumer products where content such as computer code or users’ game play progress is involved.”

“Congress did not intend to grant manufacturers the power to eliminate competition for replacement parts, accessories, or repair services,” added EFF Senior Staff Attorney Abigail Phillips. “That’s bad for consumers and bad for innovation.”

i could see why online modding would be bad, but the simple stuff like modding campaign should be allowed. it doesn't affect anyone, it doesn't ruin the experience for others. it effects you and only you. modding shouldn't be illegal. what should be illegal is the **** ridiculous prices and restrictions that microsoft forces upon its consumers.

Waltee I bought a memory card for the 360 a year or so back that allowed me to use (I think) mini SD cards up to 8gb as the official 512mb memory card was an appalling 30.

Then 3 weeks later they released a dashboard update that stopped all unofficial memory cards from working forcing me to buy an official one. I wouldn't have even bought a 3rd party card if it wasn't for the shocking price of Microsoft's official accessories.

It's shocking and in my opinion shouldn't have been allowed.
great point you can get like 4-8gb flash drive for the same price as a 512 mb official microsoft memory card, it si bullsh*t

There is no way that would happen there are thousand of 3rd party controllers,some which are designed for tournaments and some which improve on the xbox controller its self. ( Thecontroller i have is a razor onza tournament edition )

they are just looking for more money as always.

would be pretty hard to ban turtle beaches mate :D they'd have to find a way to stop the microphone port on an xbox pad to only work for an xbox official headset...... HIGHLY UNLIKELY

Their sueing them basically for manufactoring and selling their own transfer cables for $50. L M F A O 2 years ago Microsoft was handing them out to anyone thar called and asked for one. (Me and my friend got ours the day after UFO mods got patched on COD4). Anyways, Microsoft is full of crap, like always. And besides now a days you dont even need the cable, you can USB mod. Way to go Microsoft have fun losing money on a retarded lawsuit you're going to lose.
