I think you are all slightly wrong here. If you play on an official copy of the game you will not get banned, a lot of pre-orders arrive early so it is not your fault you got the game. If you play a pirated copy on a flashed xbox it's a straight ban. If you are playing an official copy I expect the leaderboards will still be reset @ midnight on monday, but you will not get banned.

i would say dont flash ya xbox, Joe played it offline and on a non gold acc and he still got console banned

Well like you said its mw2 so you can just get your xbox flashed to the latest firmware v1.91 and then youll be alright to play online just make sure everything has been done right and you run the game through abgx360
