no the way that it works in the software world is that stores apply for gaming license. Once they have them they can buy games from store at a price that they can make a profit from. The moment the stores receive the game it is considered sold as far as the dev is considered. If the store is caught selling games early the only thing that can happen is they get there license removed ( literally almost never happens). If an employee is selling the game it is considered thievery unless they pay the store before hand. in that case the worst they can do is fire him. The buyer can not get in any legal trouble. They can get banned if the company chooses to. However Call Of Duty games have been played early since MW2 by the hundreds. The chance that you are going to get banned is so small you shouldnt even think about it. Coming from someone who both has attempted and succeeded in getting COD games early (Black ops).

The second thing which makes me believe it's bullshizz is this quote. You said Activision took down a fake video, well if this video was supposedly fake, Activision wouldn't have the legal authority to be able to take it down, due to it not copyrighting any of this content.
