Im pretty sure if you had a legitimate copy it would not be your fault. It would be the companies for leaking it. An illegitimate copy would all be based on the game companies TOS and COC along with microsoft's. Im also pretty sure that as long as you dont distribute it youll be fine (EX: your allowed to own a Jtag just its against the law to distribute them).
