Most of them are leaked off the internet so they use it on their jtag or Flashed Xbox which can go online.

If you know someone who owns a shop that sells it, or the deliverer of the game to retail stores, you can possibly get it early.

the ones who got it illegally via download, well... yea thats self explanatory.

And sorry to burst your bubble, but pre-ordering doesn't allow you to get the game early. They simply reserve a copy for you to pick up.
