well its not 4.3.3, so its either 4.3.5 or 5.0, doesnt matter more than likely u will have to update anyway, its better off updating, 4.3.5 has shitty battery(drains it in under 4 hours, not playing,so does 4.3.3) and 5.0 has MAJOR issues and glitches

If you have your iPod right now,go to settings -> General -> About

Or check on iTunes.

It will most likely be ios 5 seeing how there new and all.
