I can think of at least 10 ways Infinity Ward could write a simple C sharp script and execute it via their command terminal.

Here's an example script:

Even though I wrote this in a few minutes there are some errors with it.

tl;dr: Infinity Ward can ban anyone, with a simple C#, C++ or Java script. No. They don't care if it's "1/4" of the Call of Duty: MW3 community.

You think you're "secure" but if you hack, or glitch against their Terms of Service it can result in a ban. IW is not naive and is smarter than most of you 12 year old's thinking your account will be 'safe' from IW's ban.

TheTechGame doesn't consist of a million people online at once, nor does Modern Warefare 3 on Xbox 360.

Are you stupid. Your seriously saying that the few 100,000 people that play MW3 everyday, Most have done this glitch?
I do not know anyone who has done this glitch, and there isnt enough people to know this glitch and/or with a prestige token to do it.
Its a big exploit in the game and they have every right to ban for it. Its their game not yours, either way they are going to still make money on it.
They have made millions of CoD Elite another big percentage of the fanbase is going to get it for christmas.

You have every right to be banned. You have exploited and abused a glitch which is basically altering gameplay for you. There was bans for boosting, Me personally think this is worst than boosting.

Just because there isnt millions of people online at once, doesnt mean millions dont play.

Average of like 400k people online, (i think) and thats throughout the whole day. Its not the same 400k people online, its different people getting on and off of the game, so it accumulates over the day to be more than a million people playing, per day.
