Well.... As much as everyone has come forward and said no, then actual answer is yes. Yes they are illegal.
However, this is only if you run a hacked Kernal. If you were to just run Xellous, then yes, as XDK said, you can "Do what you like with it". It is illegal to modify your NAND, under intellectual property rights, though not so severly that you would be heavily prosecuted to the fullest extent of the law.
Think of it this way, if you buy a CD do you then own the songs? Obviously you are free to change the physical properties of the disk, but not to use the songs to create your own songs lol.
