Yes they are illegal, copyright law states that you cannot copy the game and sell it off to anyone else or even make one for that matter. Its basically pirating, they have rights over their game and by buying the game you follow/accept their laws of copyright infringement

modding a iso from a game you own for ur self is not illegal selling a burnt game to someone modified or not is illegal and is a felony in the states.and no you dont need a retail copy to play just a flashed drive.
