yesterday, someone got my friends login on xbox live, and bought a game. He thinks he knows the Gamer-tag. He spent some of his money, will he get his money back, and will the guy get console banned. Does this happen alot?

microsoft can ban him but thats probly it and they can check the ip of the person who was on it last or the day it got stolen.

Ive Just had the same problem
Someone got into my account and spent 34 pounds on microsoft points,
Microsoft said i will get a full refund but they have to investigate who did it,
This can take anything up to 25 days so for this time no more Call of Duty
i also get to keep the 4000 microsoft points!
