its okay it was only 4000 MSP and i get to keep that and microsoft are looking into it and i get a refund!
and i got a free acount!
So phone microsoft tell em someone hacked your account!

Ok just to let you know, all Microsoft have to is look up the account activities.
So basically they will be able to see who recovered the account and find the console serial numbers of who recovered and etc.
The only proof you need to Xbox Customer Support is your name, address, city, state, and zip code and of course your console serial number.
If you do all this then Xbox Escalations Team will lock your account and investigate it.(You said they already told you they did this)
Once they gather all their proof and information the user's console will be banned.
Just for the inconvenience the guy who had unauthorized access to your account, the Xbox Escalations Team may give you a refund of how ever much he spent on your credit card.(Through Microsoft Points and/or Xbox Live Gold Membership)
Don't worry, he basically committed fraud and he will be dealt with by Microsoft.
