Like it has been said Jtags are not illegal; what you do with them is.
If you copy a game onto the jtag: Illegal
If you have a emulator on your jtag: Illegal
If you just play reg. game on a Jtag: Legal
If you don't want to do anything illegal with a Jtag then you might not as well get one because they are useless if you are trying to be legal. They can't get online and there main purpose is to modify the written code of the game and to do that you have to have the game copyed to the HD.

1. No not at all unless you host.
2. Yes and they got banned not everyone get caught tho.
3. Not that i know of.
4. Banned from playing online unless you put a new KV in it or have a retail xbox.
