You're idiots if you believe this:
Why??
1. It's not hard to obfuscate the index.html and the make the file undetected.
2. If he had no knowledge of this being detected, then surely he can't be guilty? Surely he would of done something to remove the detection?
3. Java Drive By's require a file to be download which is usually placed inn %APPDATA%
4.When the client is opened, THAT is the thing that would have the detection usually, McAffee is throwing up false positives because the Java is launching an application, because of that signature mcaffee thinks it's launching a malicious byte

tl;dr
McAffee is throwing up this detection because of a digital signature comprised with the Java Client (digital signature = a specific line of code, in this case it would be to launch the client on minecraft or w/e..)
