Well..
TTG Staff members Don't want anyone to get scammed more then they do. They also want to keep the community clean and don't want to risk anyone's computer, personal information, etc. There just looking out for the community and preventing something bad before it happens.

And modding programs aren't illegal if the publisher/creator post them on the internet for free downloads, like modio.
So I don't exactly see where your coming from...
Also, JTAGs do not hold copyright restrictions, people are posting programs which DO hold copyright restrictions so they have to be closed and removed otherwise TTG is liable for a law-suit for pirating copyrighted material. 8)
