Could you get banned for using a modded controller?

no I have never seen anybody banned by using a modded controller but for other things yes

Yes, if you abuse the modded controller in online player matches, Infinity Ward will suspended/ban you from MW3. If you don't believe this statement go to Infinity Ward's Twitter account. Scroll through some of the tweets and find the one posted March 9th 6:30 PM.

"we have been handing out bans to players caught using modded controllers to their advantage. Ex: Using MK14/Snipers like ARs"
