Is penguins(bunch of random numbers) a real xbox enforcment because he joined my party (friend had unbound clan tag) and said we was gonna ban him and he said in his bio xbl code of conduct something to the point of he will turn you into a xblpet! is that for real?

No, the only way to get someone banned is to report them but to be a enfourcement you have to have XBLPET in your name.

What You Get Console Banned For

Threatning Wrong you will get issued a XBL communication suspension (You may or may not be banned along with a visit from your local police.)
Infections / Mods Wrong you will get a 12-31-9999 Account ban (This is true.)
Recovering / Making Too Many Accounts Highly Wrong,No action will be taken (Recovering an account that is NOT yours will warrant an immediate console ban. Otherwise, you cannot make/recover too many of your own accounts.)
Destroying Property Makes No sense, No action will be taken if this is possible (Don't even know if that's possible.)

What You Get Profile Banned For (12/31/9999)

Simple Profile Mods Agree (True)
Language/How You Talk To People Wrong you will get issued a XBL communication suspension (True)
Anything Bad In Your Profile Wrong you will get issued a Suspension (True)
Marketplace Theft Wrong you will get issued a Console Ban (If you commit marketplace theft you have about a 50% chance to be profile banned only and 50% to be console and profile banned.)

Tada. You also forgot to add things like Asking For Email (immediate profile ban), Impersonation of Staff (temporary ban) and some more.
