In my opinion what they should do is have a map editor sorta like the valve hammer editor that is available through cod elite. Once you download this you can create your own maps and upload them to cod elite where you can then download your maps (or anyone else's for that matter) onto your console and play them with other people. This way you are not copying from Halo and you can still create maps.

Any game developer has the power
I think it would be pretty cool to make your own map to mess around on; or at least make it so you can add things to a map

Far Cry 2 has the best forge, makes maps from scratch and get to play them online. Miss that game but was hard to aim just like in BF3

That's Halo's thing. Treyarch won't add this into the game.
