Not that I know of, unless of course, you're somehow exploiting a glitch resulting in marketplace theft. But if you're just using it to transfer items like it's intended for, then I really don't see any way of getting banned. If you could, what would be the point in putting that feature on Xbox Live?

Yes modding anything to do with profile will have a chance of ban. Execpally when the game requires live.The point of doing it is to be able to get dlc/arcade games for free. So if you don't get banned its really useful and worth it.

I have been doing it for a while and have not got banned. I do not see why they would put the feature their if it will get you banned.

Nobody can tell you if you can/can not get banned. Microsoft bans you for anything "mod" related.
It's not a guaranteed console ban, but it could be. crap, if putting "thetechgame.com" gets you banned, I wouldn't be surprised if they go far enough into console banning for transferring, then again it's considered stealing...So yea, no definite answer.
