Okay, so I have an iPod Touch 1st gen but have the 3.1.3 software. I went to upgrade to the 4.0 software but it says that 3.1.3 is the current software...Can I upgrade to the 4.0 software or do I have to get a new iPod?

That sucks i have the 2nd Gen and i updated fine. I guess you probaly need a new iPOD

nah you just have to update your ipod
you shouldnt have to buy a new one

its all good
i'm pretty sure that the 1st gens are still able for the os 4.0
anyway if it dosent work just keep with the 3.1.2
4.0 isnt even that good ;)
