can you get banned for getting avatars for free by putting them on a usb then onto your xbox?

Why are they trying to ban Xbox in the US? I've heard about it before, but thought it was so irrational that it would never pass. But it's nearing. Also, if the ban is passed, would this cease all XBL play in the US?
