It can't be patched, Infinity Ward sends a file to your xbox when your banned that deletes your rank over time. Infinity Ward does not have the right to delete it themselves. So sending the file is the only way.

thats been patched for a wile now i tried that when i got reset because i was the first person in the world to hit 20th prestige before the update was out

No. Your profile receives the files from there servers. And your just deleting & re-updating the game.

yes but if they catch you playing with the same level after a ban you will be console banned so there is no point unless you have more than one xbox
