So for 10 months I've not paid for gold at all on my account, so basically I was stealing from them though it's their fault for not charging me. And a few months ago I lost my bank card and had to get a new one and Xbox some how knew this and asked me to update my payment details which I refused to do and I got spammed with emails asking to do so and I finally added my Paypal as a payment option which is verified, and now I'm banned from Xbox, no date nothing just banned I appear offline I get no perks of gold/free. So my question is can they sue me for not paying?

No. You just have to pay before you get online. So basically you will have to pay for your WHOOLE time of free live.

Yes Our_Enemies is correct you have to pay the money back and they will unban you when you pay the money you owe them
