I'm not sure if you can actually get this as your gamer-picture. I thought that it was just a default picture for people who don't have a gamer-picture on the Xbox Forums?

when you get the option to choose a default avatar you need to press the guide button to cancel it then go to avatar editor click take picture and then set it as your gamerpic.
