So the black ops 2 beta can only be played right now from a jtag xbox? And if so why cant the beta be playable on an unmodded xbox? Why cant it be like the gears of war 3 beta where all i had to do was download the file from my computer and put it on a usb?

The only way I think this could be done is if someone created a container package so it can technically be an XBLA+ title that way you can burn it to a DVD and rip it to your hard drive (assuming your console is flashed) and run it but you will most likely be banned very fast for market place theft (Account and Profile)

Gears of war 3 had a public beta where anyone who had a code could download it on there normal xbox, the beta was MEANT to be played on a normal xbox. The black ops 2 beta was never public, so it's only meant to be played straight from the game files. Only jtags and rgh's can do such a thing.
