Things can never be fully patched as long as unsigned code is online, xex modding is unpatchable to a point removing functions patches things or adding checks can cause a trip up by less experienced modders but there is always one guy who will release for alittle bit of internet web fame, personally memory modding is very hard to patch for all the raw data is sitting in the ram you cannot blame the makers of the game for that, it is up for the console designers to protect from that.

I doubt anyone will be able to modify Black Ops 2 when it comes out anyways. If they do, it will get patched almost instantly.

If you are referring to the iHc James guy, then no he did not mod the retail copy of Black Ops 2.
He had the developer's copy which is completely different from the retail.

That would be the only way that the company or producer would know that there are exploits, exploring where these exploits come from.

Honestly, if it's game-breaking and in public matches, I prefer it gets patched. For example: **** RAPID FIRE UNLIMITED AMMO ZERO RECOIL BARRETT .50 CAL **** ******!!!
