It's quite common sense to not go online with a game that isn't out yet.

Also on the rules it states you can be and will be banned for playing pre-released titles.

people who get the legit game early will not get banned, when your burning an iso on to the disc, the disc does not have the xbox code around the inside of the disc, the legit copy has this so MS know you have a legit copy so people with ONLY the ISO get banned not the people who have paid for a legit copy from a retailer the last thing MS wants to do is get themselves into a lawsuit.
