I've been doing that with Call of Duty since WaW, the shop I go to get's it in 3 days early and sells it there and then!

And then you play the game and any achievements you get are time stamped, which means they can easily look at them and see they were pre release in your area, and voila...console banned.

Actually, if the servers are online which I will check then you will be allowed to play the game because the servers are up, voila!
