I went and emailed MS in relation to my console ban in a attempt to get information which is lawfully mine. If you read the response it seems VERY automated. And it does not answer anything I ask.

I said
TTG_JoE_oH wrote I called your support yesterday and received a call back today by a supervisor or someone who deals with escalations. I was calling trying to find out the information which You (Microsoft) hold about me. As you may or may not know it is my Legal right under the Irish Data Protection Act 1998 to know any information that you hold about me ie. Console ban reason, obviously there is a Log of my profile or whatever with details of why i was banned and the reasoning behind it. And if Microsoft will not ban a console without overwhelming evidence that it has been used to violate the Code of Conduct or Terms of Use. I would like to see this Overwhelming evidence that you have about me. Joe

I got this in reply
Microsoft wrote Dear Joe ,

Thank you for contacting Xbox Support.

Microsoft is actively banning consoles from Xbox LIVE as part of our commitment to combat piracy and support safer and more secure game play for the more than 20 million members of our Xbox LIVE community. All customers should know that piracy is illegal, and that modifying their Xbox 360 console to play pirated discs, violates the Xbox LIVE terms of use, will void their warranty and result in a ban from Xbox LIVE. The health of the video game business depends on customers paying for the genuine products and services they receive from manufacturers, retailers and third parties that support them.

If Your Xbox console has been banned for one or more violations of the Xbox LIVE Terms of Use we cannot undo your console's suspension. To protect the Xbox LIVE service and Xbox LIVE members, we do not provide details about a specific console banning. We can confirm that Microsoft will not ban a console without overwhelming evidence that the console was used to violate the Code of Conduct or the Terms of Use, which can be found on [ Register or Signin to view external links. ]

This would also be a good time to remind you that the warranty on an Xbox 360 console is not transferrable and if you purchase a used console that has been previously banned; you will not be able to connect to Xbox LIVE. Also if you purchase a used console that has been previously banned, you will not be able to connect to Xbox LIVE.

Kind regards

Ashley Anderson,

Xbox Service and Support Team

That is totally automated. Get your parents to call a lawyer, and get a lawsuit against them, that is the only way you can get them to pay for doing wrong.

People saying to sue them, please stop.
If Joe sued them he would be rich! But there would be no xbl.

Joe if i were you i would just repeatedly send them messages.

Yeah he would have enough money to buy a new Xbox, and get a new live account. With the 1998 Data Protection Act, he will win, without the shadow of a doubt.
