Have you tried maybe calling Microsoft and telling them whats going on ? If you haven't then i would say that this might be the best thing to do in your situation.

Will I be able to get a refund and would it be a good idea to take him to court?

I work for Xbox support. Change your email address that is associated with the account and THEN change your password. He can't sign back in without the correct email. Then contact support.xbox.com and inform them of the situation. (Do not spend any of the unauthorized MSP) They will assume control of your account for a few days to see where it was recovered, then issue you a refund for the unauthorized MSP.

P.S. He didn't hack you if you gave him the email address. So leave that part out when you contact support ;)
