My iPhone 5 does not have this problem however one of my close-friends did, they took t into Apple and they just gave them a new handset, everything was transferred due to iCloud. If I was in your position I would take it into Apple, it's under warranty so what do you have too loose?

Apple give you a years warranty with every product purchased.

I recommend taking it back as they will most likely replace it. Plus you have 1 year warranty so your not going to loose anything
