You obviously would, this is PSN. And the reason to upgrade would be to get the better graphics and what not, kind of like what they did with the xbox slim. It would make no sense to not be able to play with someone on an xbox just because they have the newer console. Honestly guys, use your brain. Xbox live is xbox live. No matter what console you have if it has to do with XBL then it should all be compatable.Just like on the internet. You can send messages from your computer on xbox.com to people that are on xbox. So the answer to this is Yes. I saw something to do with battlefield 4 and how the 720 would run it way smoother and be able to compete with PC, and they said something about the 360 wouldnt look as good as the 720. Dont quote me on this, i forgot what article i read on it. Look it up.

It depends.
If it's backwards compatible, you could probably play MW2 or any other 360 game on the 720 with the rest of the people no matter what console. Let's face it, people on the 720 may not be playing only 360 games. So it would be horrible online. Plus, I think it's the game developers choice.

As far as I know, (don't get mad at me) but I am pretty sure that the xbox live from the original xbox could still play with the xbox 360's xbox live players. I could be wrong but I don't know since I wasn't around to play xbox then (playstation 2 b*tches) Anyway why wouldn't they do backwards compatible. It drops their profit because they won't sell the NGX's to any 360 players who are loyal to their new game.
