has this been patched? i was doing it earlier but now when i get to the point where i have to back out and bring party, it takes me out of the online menu

It hasn't been patched you're doing it wrong. Your friend needs to be in the PUBLIC match menu, not the MULTIPLAYER one. Follow the tut carefully.
