i'll try and put this in a short term but erm
i haven't been on my xbox for nearly a week and i'v noticed money has been going from my bank account nearly 50 has been spend on microsoft point's and i thought it was odd because i haven't bought point's in week's but i then go onto xbox.com and i see some idiot has been buying points on my account and has been buying avatar costume's..fifa coins what ever their called..gear's of war xp stuff and so on..

and the the recent games the person has played are.. minecraft,gta,netflix,4od,bbc iplayer,mw3,internet explorer,fifa13,black ops 2..now the only games i own on there is black ops two and mnecraft and the other's i have never downloaded,if i ring xbox n the morning do you think they can track whitch/where the stuff was downloaded from because money just keeps going from my account and i'v changed my password twice and they keep getting on,and because money has gone from my bank because of this isit legal to take it to the police?

I'd call Microsoft, they might be able to do something about it. Then definitely talk to your bank and make sure you freeze your card. I wouldn't cancel it yet, but as soon as it's all sorted out definitely cancel it.

is there a way i could delete my xbox account with all the details along with it and start a new account?

If you wanted to freeze your xbox account so that no one can do anything MS can definitely do that. As for deleting it, not sure. You removed your payment options from your account though correct?

Contact Microsoft, they will be able to freeze your account so no one will be able to sign in on it.

there not open right now well the uk help line isn't ,i have tried to remove my payment options but because it's on a monthly pay for live it simply wont delete well the paypal link wont anyway

Call Microsoft and tell them what happened and explain you want them to remove all statements and refund you.

I hope you get better service from Microsoft in the UK than I did in the US. Microsoft had charged me 3 times for a one year coming out to to around $180 suspended my account because there wasn't that much money on my card, wouldn't let my account be un-suspended until I payed the $180 then after I did they charged me another year and refused to refund my money. Hope you get everything sorted out

even if it was somebody on my account who bought the point would microsoft still have to give me a full refund because of it,every time there's a problem with my account they try to turn it around as if it's my fault,i mean it's not as if there not getting enough money but charging you three time is a complete joke,if they don't sort it out i'll say i'll switch to a different company like ps3 they then change their mood

I'm pretty sure you can just just turn off automatic renewal by going into settings on the computer then you should be able to remove your payment options.
