No you can't transfer downloaded games from the marketplace, I don't think you can do it with a transfer cable.

1. The answer is kinda complicated, yes no doubt you would be able to move your profile to your JTAG but when it comes to the games you can put them on your JTAG and put them on the regular hdd, but you would not be able to mod these as these are in not in xex menu and you can't get the files into xex menu due to how the USB would be formatted. The is a chance that you might be able to use XM360 and this is meant to unlock DLC and Arcade games but I have never heard it being used for full games before. You can always if this fails just borrow the games from a friend for the day and install them in xex menu and you will never need the disks again.

2. If for some strange reason you connect to xbox live, all that would happen is that your console would be banned but that doesn't do anything and if you ever wanted to get online with a server, you would just get a new Keyvault.
