so i have an R4 Card and i want to back up some games, the ones i lost.... is that legal????
its for the DS Lite

If you have had them before and purchased them then yes it IS legal. However most people just download games they want anyway because nintendo cant do much about it.

You wont get caught for downloading games you don't own for your r4 card it would be to much to try and catch people for that kind of piracy so that's why the Nintendo updates try to block the r4 cards but technically if you have bought the game legally you are allowed one downloaded or backed up copy.
