Don't do it mate, you get perma banned within 24 hours from xbl.
Trust me, I did it last night and logged in as morning to find I was banned.
I think they can tell if your profile was recovered onto a Jtag/RGH.

If you/the person doing the lobby is on XBLS platinum or XBLSE then you shouldn't get auto account bans which means they should be safe
