I don't think so because if you copyright you just have to take down the video or de-monetize it and if you do it too many times you can't upload anymore.

Yes, I would say it's possible. If you upload something that is copyrighted, get it monetized and make money off of it, that is copyright infringement. You can be sued for it, if the case is serious enough. In most cases YouTube will just handle it themselves, considering a lot of cases aren't extreme.

No, Everything having to do with Copyright and Monetization is run through by Youtube. If you were to break the Terms of Use Agreement. They will fix it and give you a warning (In a way) But if you continue to break the Terms of Use, Your Youtube account could result in termination of that Youtube account and will have to make a new one.

In the case of hacking no. Unless that person was to gain access to your brother's adsense account, and take money. If so, that is fraud/theft, and authorities can be involved. I recommend contacting Youtube. If it is just a normal case of "hacking" then call them and what they can do. If you do get it back, I recommend setting up a login verification. This will prompt for a code, sent to your phone number, when logging in on computers you don't usually log in on. Good luck!
