A handful of people have real copies and have been playing online they haven't been banned. They're not going to ban anyone for going online with it. They don't even know who's is retail or not. Plus if you play it offline the logs on your xbox will say you were playing it anyway so you mine as well go online. Won't do any harm

MS support said that if its a Legitimate copy you cannot be banned.
