As long as you have a legitimate copy of the game that had been sealed. If it's burned or an ISO file or anything like that then you can be banned.

i have an ISO disk (not legit copy) and i am fine due to my stealth patch ;)

Yes it is safe, they turn on the servers cause InfinityWard actually gives the game early to Reviewers, so they can play and write their reviews before release.
