Surely if someone just went into a public match and accidentally got into an XP lobby they can't get banned for it? That would be ridiculous....

Most people won't get banned cause they turn the servers on so Reviewers such as Gameinformer can review it by the time it releases it's not like they know who a reviewer is and who isn't but now getting into modded lobbys thats different

If they decided to stay in it or back out and rejoin then yes they could. If they just got into it by searching for a public match then got a kill or two then left or waited until the game was over and left then it's more understandable.
