actually you could still be prosecuted in the UK, because the UK law states that if you receive an item OR currency from someone OR a company that expects payment in return and was given to you in error and you have knowledge that you haven't paid for the product you can be charged for the item AND charged a small fine usually 60-80 GBP for theft.

Because technically yes the error is theirs BUT if they do realize that they have stock missing and tract the bar code and find that the product was sent to you which is possible as its usually scanned via the courier they could decide to prosecute if you do not pay full RRP or return the product in its original condition.

The choice is obviously yours and like i said its an IF, they may not chase it up but if they do be prepared to pay for it.
