I think it is but some people might think other wise. But in my opinion for your safety, I would say start fresh with a new character.

How does it not make sense? If you report a jtag user to Microsoft with solid proof they would be banned in no time..
It dosent make sense because why would they console ban me for changing my dns? It's not modding I'm simply connecting to a network, anyone can do it. Cod lobby's and changing gamesaves are solid proof of modding but not dns. Same thing with license transferring; it's marketplace theft and that's considered stealing from Microsoft but I've never heard of anyone getting banned for it. I don't know that's just how I feel.

Any kind of in-game tampering whether online or offline (single player) can result in a penalty such as a ban or a temporary suspension. Of course the chances of any kind of penalty for offline (single player) modding are minimal. Your chances increase of a penalty when you start tempering with online gameplay.
Under section F. of Microsoft's Code of Conduct for Xbox Live it clearly states:
- Do not cheat in a game unless cheats have been deliberately enabled by the developer.
Do not use unauthorized hardware or modifications to gain an advantage or disrupt the competitive landscape of Xbox Live.
Do not exploit game vulnerabilities or glitches.
Do not make unauthorized modifications to your account profile or its contents, to include but not limited to: tenure, Avatar, gamesaves, or Gamerscore.
Do not intentionally play with someone who is using unauthorized software or methods.
Do not play any illegitimately obtained software or pirated games.
Do not take any action to cause degradation of service for Microsoft or other users.
Do not play a game before it has been authorized for play on the service.
With DNS mods you are intentionally disrupting the online gameplay for the benefit of yourself which can result in you or your console being banned. However, console bans are probably unlikely for those who used the DNS' a few times and have no history of modding or other hacking of games on their profiles/console.
It is up to Microsoft to decide what kind of punishment you'll receive if any. Like GTA_Lobbies said it will come down to R*'s initiative. If they feel they are overwhelmed with the recent surge in exploits and mods they will take it to Microsoft.This however will probably involve the worst of the worst; the one's who constantly modded and exploited the game, the one's who hosted hacked lobbies from JTAG's/RGH's. Of course it is probably certain Microsoft will step in to solve these DNS' exploits as it is not up to the developer to fix these. I am sure Sony will do exactly the same for their console. Of course I can't tell you what will happen, so take this with a grain of salt.
