Alright my mistake, I haven't read articles. But, in my state, DUI is the only law, there is no DWI. Either way, drugs impair driving judgement all the same

Ok, he wasn't drunk, but being drugged up behind the wheel doesn't make it better, really.

He spent maybe 2 hours tops in jail before bailing out.
You don't go to prison for a DUI.
