I keep getting a error say cant connect to party due to network limitations. anyone having this problem? or have a fix for it?

Check to see if they have the preview update/ don't have it(in case you have the update). If that's not the issue, it's probably just a NAT conflict. Try going to the network settings on your Xbox. Test both the Internet and Multiplayer connections and see what your NAT is. If it's open, have your friend do it.
If it still doesn't work, I'm sorry to hear that. Try rebooting systems and repeating if you really need to talk to each other that badly.
Alternate solution: Use Skype for voice chat. I've had to resort to that more than once due to NAT issues. If it is a NAT problem I'm surprised, as Microsoft has done well to stop most of them.

Yeah, both of our nat types are open and we are both on the preview update. We did use skype instead.

Similar thing happened to me yesterday, I think it's something to do with the update. Just carry on using Skype for now.
