A Missouri man who avoided a 13-year jail sentence because of what state officials called a clerical error will learn Tuesday if he will have to keep fighting to avoid being incarcerated.

In 1999, Cornealious Mike Anderson was convicted of armed robbery after taking money from a Burger King manager who was making a bank deposit. He was sentenced to 13 years in jail, but after he posted bond and went home during the appeals process, he was never forced to serve his sentence.

"He then waited and waited and waited for the Missouri Department of Corrections to give him a date to surrender and begin his serving his sentence, Andersons attorney, Patrick Michael Megaro, told TODAY. That day never came."

The state mistakenly believed Anderson was already in prison serving his sentence, when in fact he was living life on the outside.

"He got married, had children, opened a successful business, coached youth football, (and) joined a church group, Magaro said in a report from NBC's Joe Fryer. Did everything that you would expect a normal person to do because in his mind, he believed that maybe the courts had changed their mind."
However, just as his sentence would have ended last summer, authorities realized the apparent clerical error and that Anderson had never served time. The father of four was arrested and currently sits behind bars, waiting for Missouri Attorney General Chris Koster to respond on Tuesday to a petition from his attorney asking for his release. Koster declined comment to TODAY.

Its just very hard, said Andersons wife, LaQonna Anderson. And I miss my husband very, very much. My kids miss their father.

Anderson spoke with the radio program This American Life about his predicament.

I never felt like a fugitive, because a fugitive's someone that's running from the law, he said. I never ran from the law. I was there."

The manager who was robbed believes that Anderson should be set free.

It's their fault, so I mean it's like they're going to try and penalize him for another 13 years, said the man, identified only by his first name, Dennis, on the radio program. That don't seem right."

Nearly 14,000 people have signed a petition on Change.org asking for Andersons release, but the current St. Charles County prosecutor disagrees.

"I believe that if we allowed somebody to avoid an incarceration sentence, it's just a slippery slope, Tim Lohmar told TODAY.



What is your opinion on the subject? Do you think Anderson should have to serve the prison time?

As I told you in the shoutbox, I do not think he should serve the sentence. One, the person he "robbed" even said he shouldn't be sentenced. Two, he shouldn't have to serve the sentence since the court really didn't send him off.

I think that because
a) It was the state's fault that he never served and
b) He completely changed his life around

He shouldn't have to serve it anymore..Mainly because they made the mistake of not putting him behind bars when he should've been. They make a mistake, they shouldn't make him pay 13 years later....That's just my opinion

I mean don't feel as this man should serve the sentence but regardless he turned his life around or not. He didn't serve the punishment, which is probably the court's point of view. Although I disagree with it.

I don't think he should serve this time.
If he was committing crimes for the past 13 years I would think otherwise, but he's obviously turned his life around on his own.
Prison isn't as much about punishment as it is about rehabilitation.
He's rehabilitated himself in my opinion, making prison pointless.

He should definitely not be sent to prison, he made a better life and everything.

Nope. Prison is there to keep the public safe. The guy hasn't been a hazard in 13 years. They should just drop it. I think that is a pretty common sense approach to it, but that is just my opinion. If someone isn't a threat, they shouldn't be in prison.

He committed a crime, he is now going to do his time for it.

All this crap you people are saying of "It's been so long since than";
That is basically saying as long as you can commit a crime and get away with it for a good amount of years, you should never be sentenced.

That is basically saying as long as you can commit a crime and get away with it for a good amount of years, you should never be sentenced.


Only if the crime isn't "HUGE" (as in no one was injured & it was a rather minor crime)..And the only reason that me, and I'm sure most others, believe that in his case is because it isn't like he cheated somehow to escape his prison sentence, the state made the stupid mistake in the first place.

It's similar to teenagers getting arrested for stupid mistakes..
Of course, most of them will regret their decision and suffer the consequences even after they get older. If this guy is now an older man and he changed his life, then why would he have to suffer so long after he did it? (that's just my opinion, anyway )

He should not have to server time. If he does just serve the rest of the time he would of had. He has defiantly changed as a person.
