So he did get banned? Wow he was favorite player but after this stunt, he no longer is. My guess he will probably be in it.

No, he has not been banned yet.

And it's up to EA's discretion. If they want to they can, they don't have to. It's like in all of 2k's games, they don't acknowledge any of Barry Bond's records because the producer's do not believe it was without the help of steroids. So the company can choose to or not.

If he is banned it will be only from the uruguayan national team, not Liverpool. So, yes Suarez will be in Fifa 15.
